Overview
These Terms of Service ("Terms") govern your access to and use of the Ivite app mobile application ("App"). The App is owned and operated by MobileAppLab OÜ, registry code 17171220, Address is Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-301, 10152 (the "Licensor"). Please read these Terms carefully. By downloading, installing, or using the App in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App. Your continued use of the App constitutes your acceptance of any updates or modifications to these Terms.
1. Terms Acceptance and License Grant
1.1 Acceptance of Terms and Age Requirement
Your use of the App signifies your acceptance of these Terms in full. To use the App and purchase any related subscription services, you must be at least 16 years old or the legal age of majority in your jurisdiction.
1.2 Modifications to Terms
The Licensor may update or modify these Terms at any time. Changes become effective once posted in the App or otherwise communicated.
1.3 License Grant and Use of the App
You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes, subject to compliance with these Terms.
Unauthorized copying, reproduction, alteration, distribution, public display, or reverse engineering of the App is prohibited. You may not use any content for competing services or any misleading or defamatory purpose.
2. Registration, Eligibility, and Account Security
You must be 16+ and legally allowed to use the App.
You agree to provide accurate information when creating your account.
Use of another person’s identity or misleading credentials is prohibited.
Keep login credentials secure. You’re responsible for activity under your account.
You consent to the Licensor accessing basic information if logging in via third-party services.
3. User Obligations and Restrictions
You agree not to:
- Use the App unlawfully or for commercial purposes without permission
- Reverse-engineer, copy, or scrape content
- Share your credentials
- Distribute the App or use it to develop competing services
4. Disclaimer of Warranties
The App may not be available or suitable in all locations.
Services are provided “as is” without warranties of any kind.
No guarantee is made regarding uninterrupted service or the accuracy of information.
You are responsible for any damage to your device or data from use.
The App cannot guarantee specific outcomes or improvements.
We do not provide professional medical advice and disclaim liability for reliance on app content.
Some exclusions may not apply in all jurisdictions.
5. Limitation of Liability and Indemnification
The Licensor is not liable for indirect, incidental, or consequential damages.
Maximum liability is limited to $100 or the total amount paid for the App, whichever is greater.
Some limitations may not apply depending on local law.
We are not responsible for inaccuracies due to user error.
We are not liable for personal injury related to use of the App.
You agree to indemnify the Licensor from claims resulting from your use or violations of these Terms.
6. Intellectual Property Rights
The Licensor owns all intellectual property related to the App.
You agree not to claim rights, infringe, or misuse any of the Licensor’s intellectual property.
7. Subscriptions, Updates, and Support
Subscriptions and Billing
Auto-renewing subscriptions may be offered. Billing is handled by the App provider (e.g., Apple App Store).
Updates and Support
We may offer updates at our discretion and are not obligated to provide technical support.
8. App Providers and Third-Party Terms
If the App was downloaded via an App Provider:
- These Terms are between you and the Licensor only.
- The App Provider is not responsible for support or legal claims.
- You agree to third-party terms as applicable.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Estonia.
Disputes will be resolved by the International Commercial Arbitration Court under the European Arbitration Chamber. Language: English. Seat: Online.
You waive class action rights.
10. Term and Termination
These Terms remain in effect until terminated.
The Licensor may suspend or terminate your account for violations.
Deleting the App ends access. No refunds are provided.
11. Final Provisions
These Terms are the complete agreement between you and the Licensor.
Amendments must be in writing and signed by the Licensor.
Invalid provisions will not affect the rest of the Terms.
Failure to enforce any right is not a waiver.
You may not transfer your rights under these Terms without consent.
